Objectives

The research project "Legal instruments and their impact on the Austrian cultivated landscape" investigated and analyzed the implementation of environmental law and agricultural law as policy instruments in Austria and their effects on the cultivated landscape.

The study aimed at

  • identifying and investigating of the interdependencies between policy instruments and societal mechanisms which have an environmental impact on the landscape by mapping the implementation process.

  • analyzing effectiveness and efficiency of environmental policy instruments at the international and national level.

  • analyzing the role of environmental law for the development of the cultivated landscape on which recommendation for policy will be based.

Starting from analyzing the international context of the national environmental policy a set of various instruments at different levels was investigated in case studies. These levels were the European Union and its environmental policy and instruments, the multilateral level as well as the pluri- and bilateral level of international agreements on the environment (Climate Convention, Montreal Protocol, Danube Protection Convention, bilateral agreements on water management with Hungary and the Czech Republic). With regard to agricultural law the analysis started at the national level. The implementation is analyzed for environmental policy instruments (energy taxation, natural protection) and agricultural policy instruments (ÖPUL-measures) with relevance for the environment.

Work therefore was divided into two subprojects:

Agricultural economic implications of legal instruments (carried out by the Institute for Agricultural Economics of the University for Agricultural Sciences, Vienna) "Implementation of international environmental instruments in Austria" (carried out by the ICCR, which also co-ordinated the overall project, in collaboration with the Institute for International Law of the University of Vienna.

As synthesis a planning tool for legislation, that takes into account requirements of sustainable development, was developed.
